Right to be accompanied

In Toal and another v GB Oils Ltd UKEAT/0569/12, the Employment Appeal Tribunal held that the right to be accompanied at a disciplinary or grievance meeting is “absolute”. The employer cannot reject the employee’s chosen companion.

If an employer does reject the employee’s preferred companion, it may make an otherwise fair procedure unfair.
