Discrimination by association extended to indirect discrimination

The European Court of Justice’s Advocate General Kokott has given her opinion on whether the concept of discrimination by association can be extended from direct discrimination to indirect discrimination.

In her opinion, the definition of indirect discrimination in the Race Directive is not inconsistent with the concept of associative discrimination. Therefore, the fact that the concept has only arisen in cases involving direct discrimination does not mean that it cannot be considered in an indirect context.
